The following terminology applies to these Terms and Conditions and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting Tax Support’ terms and conditions. “Tax Support”, “Ourselves”, “We” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of Tax Support’ stated services/products, in accordance with and subject to, prevailing Australian Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Confidentiality

Client records are regarded as confidential and therefore will not be divulged to any third party unless legally required to do so to the appropriate authorities e.g. Australian Taxation Office or ASIC. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.

We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by Tax Support will only be in connection with the provision of agreed services and products.

Communication

We have several different e-mail addresses for different queries. We prefer communication via email in the first instance. These, and other contact information such as telephone number, Facebook and Twitter links, can be found on our Contact Us link on our website and on every page of our website in the top right hand corner. Contact details are also found on Tax Support’ various stationery.

Data Errors & Liability

Tax Support will make every effort to ensure that no errors are made when processing Clients’ accounts. Tax Support will not accept responsibility for data or information received from Clients which may lead to possible errors occurring.

Clients must review all work completed by Tax Support within 7 days of it being returned to them and any necessary changes must be brought to our attention immediately. After 7 days no liability for any errors will be accepted by Tax Support.

Payment Methods

IntegraPay, Cash, direct bank transfer, Visa and MasterCard are all acceptable methods of payment. American Express Card is not currently accepted. We encourage payment for Tax Services packages be via a direct debit arrangement although this is not mandatory.

Payment Terms

If an agreement directs clients to pay hourly fees i.e. non package services, then our terms are payment in full within 7 days from the date of invoice. Clients receiving non package services will be invoiced on a weekly basis until the Tax Services agreement has ceased. Clients choosing to purchase packages will be required to pay one month in advance on the first day of each month preferably via means of direct debit however, this is not compulsory. Packages are supplied with contract. Tax Support will provide a monthly invoice to clients who purchase any package.

Clients wishing to cease purchase of packages must advise Tax Support that they wish to do so in writing at least 30 days. Those clients paying via direct debit must provide written notification that they wish to cancel the direct debit arrangement as it will continue until such notification is received by Tax Support. All goods remain the property of Tax Support until paid for in full.

Prices shown on Tax Support website are in Australian dollars and are GST-inclusive.

Outstanding Debts

Monies that remain outstanding by the due date will incur late payment interest at the rate of $16.50 (inc GST) per week on the outstanding balance until such time as the balance is paid in full and final settlement. If the debt becomes 30 days past due Tax Support will cease all services and any agreement/s will be placed on hold until the client has paid the total amount owed plus any applicable interest fees.

We reserve the right to seek recovery of any monies remaining unpaid 60 days from the date of invoice via collection agencies and/or through the Small Claims Court. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

Termination of Agreements, Cancellations and Refunds Policy

Both the Client and Tax Support have the right to terminate any Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused services shall be refunded. Clients must notify Tax Support in writing if they intend to cancel any Tax Services agreement and/or package service.

Availability

Unless otherwise stated, the services featured on this website are only available within the Australia. All advertising is intended solely for the Australian market. You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of Tax Support. Tax Support does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you thereby indemnify Tax Support, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Waiver

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

General

The laws of Australia govern these terms and conditions. By accessing this website and using our services/buying our products you consent to these terms and conditions and to the exclusive jurisdiction of the Australian courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of Tax Support to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision. These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by duly authorised representatives of Tax Support.

Notification of Changes

Tax Support reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on our web site 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis.

These terms and conditions form part of the agreement between the Client and Tax Support. Your accessing of this website and/or undertaking of a Tax Services agreement and/or purchase of a Tax Services package indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.

Privacy Policy

Maintaining the privacy of our website visitors and mobile application users is very important to us. Because we gather information about you, you should familiarise yourself with our Privacy Policy.

This privacy policy describes how Tax Support may collect, use and share information you provide when using our services, including your personal information.

It is important that you take the time to carefully read our Privacy Policy, so you can understand our practices as relates to your information.

We will ask for your consent before using your information in any manner and for any purpose other than as described in this Privacy Policy.

Information we collect

We only collect data from you that is required for the purpose of completing your consulting assignment. This can including names, addresses, telephone numbers, email address, credit or debit card number, Tax File Number (TFN), Australian Business Number (ABN), Australian Company Number (CAN) and any other information that is needed.

Data collected from you will include addresses, telephone numbers, email addresses and postal addresses relating only to your business. We do not collect your personal contact details unless you provide them (because they are in some way related to your consulting assignment).

We will also collect data relating to your taxation status e.g. GST registration, Australian Business Number, PAYG registration and business structure type. We may also require your Tax File Number and information relating to your superannuation fund membership.

If we process your payroll for your business, we will have access to your employees’ personal contact details, their Tax File Numbers and superannuation fund membership.

If you request that we have access to your online business bank account, we request that you arrange this via your bank. We do not ever use your personal login details so do not provide them to us.

Other Data collected will relate to your tax accountant’s contact details. We suggest that you get permission to provide that information to us before doing so.

We collect the above data by way of questionnaires, forms, telephone meetings and Skype meetings. The data is then recorded in our database which can be found in our management files and also Google Drive and Dropbox. Some of this data will also be accessible from a client’s accounting software.

Data is collected from you, the client in the first place, however, we may collect data from your employees if you have first given permission for your employees to do so.

If you wish to complain about how we have dealt with your data, please put your complaint in writing either via email or a letter and address it to Tax Support (address details can be found on our website). Your complaint will be considered and you will be involved at all levels of any discussion that may result.

Collection of personal information

If we receive information about you which is personal in nature and which is not required for purposes of completing your consulting assignment, this data will be destroyed either by way of paper shredding or deleting a computer file. We will also advise you in writing about what was received, how we received it and how we disposed of it.

Dealing with personal information

Your data is held by us in strict confidence. We will never divulge your information to any other organisation or person unless first requested by you in writing.

Our direct marketing strategy is email-based. As a Tax Support client, you will be placed on the email newsletter list held by “Campaign Monitor”. Our newsletter is sent on a monthly basis. You can easily opt out of receiving our newsletter by following the prompts on the newsletter at any time.

Even though we may request that you provide us with your Tax File Number (known as a government-related identifier), we will never use that number as our own identifier for you in our database.

Integrity of personal information

In order to ensure that your personal data is accurate, up to date and complete, we will send you an electronic form to complete which will require you to inform us of any changes and amendments to your data. We will send this form to you in December each year.

If you have indicated via the form that amendments are required, we will make those amendments in our database immediately.

The data we hold about you on your behalf is kept securely within our electronic systems which are backed up daily via our online backup software.

All data is password-protected i.e. it not possible to access any client data without first using a secure password. Staff are provided with passwords as required which are kept on a master list within 1Password, our secure password-keeper software. Passwords are required for Google Drive and Dropbox. Passwords are also required to access browser-based accounting software.

If our computers were to be stolen or lost via natural disaster, your data will remain secure as it is kept electronically “in the cloud” with Google Drive and Dropbox.

If your accounting software is desktop-based, your accounting file is backed up each time it is changed to a USB drive which is stored in lockable cabinets in our office. Backups are also saved to our hard drive which are then backed up via Jungle Disk each day as a secondary backup in case of loss of computers.

Your data will be retained by us after you cease being our client for a period of 5 years as stipulated by the Australian Taxation Office (minimum period in which to keep records relating to our business activities). After this time, your data will be destroyed and/or deleted from our systems. Any data which we believe should be returned to you will be sent to you as required after the 5 year period.

How We Use Personal Information

When you request, to connect you with vendors who will provide you with information about products and services. 

When you’ve submitted your Personal Information to us, which submission you understand and agree to constitute making an “inquiry” to us and our affiliated entities, to contact you or allow our vendors to contact you via telephone for a limited period even if the telephone number you submitted appears on any state and/or federal Do Not Call list, because your inquiry serves as an exception to state and/or federal Do Not Call laws.

To respond to your inquiries and fulfill your requests, such as to send you newsletters.

to send you important information regarding the Site, changes to our terms, conditions, and policies and/or other administrative information. 

To send you surveys and marketing communications that we believe may be of interest to you. 

To personalise your experience on the Site and our other websites by presenting advertising, products and offers tailored to you.

How We Collect Non-Personal Information

We and our third party service providers may collect Non-Personal Information from you, including your MAC address, your computer type, screen resolution, OS version, Internet browser, as well as demographic data, for example, your location, educational degree, balance on mortgage, value of real estate, income, age, weight, type of insurance, diabetic or smoking-related statistics.  We also aggregate Personal Information in a manner such that the end-product does not personally identify you or any other user of the Site, for example, by using Personal Information to calculate the percentage of our users who have a particular telephone area code. 

We also collect Non-Personal Information through the use of cookies, pixel tags, web beacons, or other similar technologies for example to help identify you and maintain your signed-in status or to measure the effectiveness of e-mail communications. We may link the information we store in cookies to any personally identifiable information you submit while on our site. 

IP Addresses

Your “IP Address” is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). 

Log Files

We use IP addresses to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within Tax Support on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

Like most interactive web sites Tax Support website uses cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate partners may also use cookies.

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any site to which this Site contains a link or a widget on our site.  The inclusion of a link on the Site does not imply endorsement of the linked site by us or by our affiliates.  We may also utilise framing techniques that may make it appear that you are still on the site when you are actually on a third party web site.

If you make a request to access your data, we will provide that data as quickly as possible and we will provide it in the format you request.

Your data will be provided to you at no cost.

Your personal data will be amended by us if required in order to keep it up to date, complete and relevant for the purposes of assisting us to complete your Tax Services assignment.

As mentioned above, we will send you a form to complete each year that will allow you to inform us of any changes to your personal data. You may, of course, send us an email to inform us of any changes to be made at any time.

Retention period

We will retain your Personal Information for as long as your account is active or as needed to provide you services and for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or allowed by law or as necessary to resolve disputes and enforce our agreements.  If you wish to request that we no longer use your information, please follow the instructions above.

Use of site by minors

The Site is not directed to individuals under the age of sixteen (16), and we request that these individuals do not provide Personal Information through the Site. 

Sensitive information
